The Military Technical Agreement between ISAF and the Interim Administration of Afghanistan establishes the framework under which international forces operate in Afghanistan. The agreement details ISAF tasks and ISAF Commander authority.

While not specifically related to reparations, Annex A prescribes that ISAF and supporting personnel is, under all circumstances, subject to the exclusive jurisdiction of the State of which the person is a national and is immune from prosecution under Afghan law. As such, each troop-contributing country is responsible for investigating and prosecuting crimes committed by its personnel in Afghanistan.
