In these Observations the ACHPR expresses concern (paragraph 80) about the fact that the Nigerian Government has not yet enacted legislation enabling individuals and Non-Governmental Organisations to refer cases directly to the African Court on Human and People’s Rights.

The Commission is also concerned about armed-drone strikes, carried out by the United States with Nigeria’s consent, to counter extremist armed groups such as Boko Haram and Al-Quaida. As these strikes cause deaths among the Nigerian civilian population, they may infringe human rights guaranteed in the African Charter (para. 122). Consequently, the Commission recommends that the Nigerian government a) ensure respect for international human rights and humanitarian law, particularly regarding the use of combat drones, b) carry out independent and impartial investigations into all deaths caused by drones and c) bring the alleged perpetrators to justice, which should include ensuring payment of compensation to the victims and members of their family (see paragraph xlvi, p. 24).
